infraction, I would then recommend each of you
follow these steps when confronting a patrol
officer or officers. Oh yes, sometimes
there are two of them who travel together.
The steps to take if you can't avoid being
pulled over
So based on experience and
collective research I recommend that these are
the best, strategic steps when facing the
approaching officers:
1. Keep a levelled head.

No matter the situation or
how ticked you are, you need to remain calm and
don't be confrontational. I almost
guarantee that there would be no way of you
getting off with a warning if you challenge the
officer's authority or disrespect him or her.
Plus, You may say something that will hurt your
chances later on if
you wanted to challenge the ticket.
Either way, be in control, make eye contact, be
pleasant and cooperative. Though you don't
want to overdo it to a point where the officer(s) become suspicious. They know
that no one ever likes to be pulled over.

2. Make sure to park it
and wait patiently.

Make sure you park
as far from the trafficked road as
possible, giving the officer an
opportunity to comfortably walk over to
your side. If possible put the
emergency brake on. Some say to
turn the car off, but that is your
choice. However if it's cold then
I say it's okay to keep it on and you
warm. With your rear and side
mirrors be aware who is coming to your
vehicle and on what side. You, the
driver should remove your sunglasses, if
you're wearing them,
and keep your hands on the upper
portion of the steering wheel. You
don't have to stretch your fingers out
over the steering wheel like you're
being searched or something. Just
try to relax a little and breathe.
If you behave negatively in any way the
officer will remember you in a bad way.

3. Be
aware of your surroundings.

When you've calmed yourself,
be aware of the weather conditions - is it
foggy, is it raining quite a bit, is it freezing
cold, is it snowing, is it misty? All
these can be important factors later on if done
right. Watch who's coming to your door.
What is the marked speed (road sign) where you
were actually stopped? See
if it corresponds with what was
recorded on the ticket? Remember where
your ownership and insurance papers are, but
don't get them until you're asked to do so.
Never make any sudden, quick movements.
You never know what the officer will be
thinking. |
4. Hello officer!
How may I help you?

You finally meet the driver
of the bright, shiny, light machine.
Remember, be polite; make eye contact; don't be
confrontational; and don't argue with the
officer. You don't want to be remembered
in a negative way. Especially if you're
going to challenge the ticket later. You
can either speak first or merely respond to the
officer's questions, but whatever you do, do not
admit you were speeding. Don't lie, but

5. Swallow it and go,
because you'll deal with it later.

I don't recommend
you to request seeing the radar.
What if it says the speed you were
clocked at, what are you going to say
then, and now the officer is annoyed?
So instead of lowering the speed you
were actually clocked at, on the ticket
the officer may keep it
at that speed and try to find something
else to ding you with. Therefore,
by this explanation I say sit in the
car, and let the officer make his/her
move. If you're good up to this
point he/she may give you a chance and
give you a warning or you may still get
a fine but in a way that will not affect
your insurance or won't put a major dent
into your wallet. Once the officer
makes his move next will be yours.
If no ticket then "Thank them!" If
you do get a ticket then the officer
will explain your options. If it
affects your insurance, puts a major
dent into your finances, the officer
ticked you off by being obnoxious, or
you feel it's not a good day to get a
ticket then challenge it strategically
by following the Win Your Speeding

away and later over a
(notice I wrote a - singular) nice
drink (your discretion) check the ticket
to see if there are any serious errors
on it. Note - some errors will be
allowable and won't get your case

6. Do you like
telemarketers calling you? Then how do you
think they'll find you?

I know some may tell you
it's okay, but I'm going to strongly suggest to
you not to call the officer at work. For
those of you who think it's a good idea,
REALLY??? The ticket is already
written and being processed. What is the
point? The officer did his/her job.
Think about it, they are in their place of
refuge with their fellow officers, and someone
they don't want to talk to (YOU) is bugging them, trying to get the charge
dropped. Sure you have all rights to speak
to the public servant and beg him/her to drop
your ticket, but if you have all that time to do
so then something is wrong and you will be
remembered. Think how you feel when a
telemarketer calls you? |

7. In case you're
thinking about annoying the Judge with a call...

REALLY?!?
Don't contact the Judge and never
contact the one who will be presenting the
charge against you, namely the
Prosecutor! Listen to me here,
Judges are paid exceptionally well,
because they have to be constantly
updating themselves with the law and any
new changes or landmarks. Have you
ever seen their books of Reference and study?
It's an enormous amount! Plus, they have to deal
with so much crap daily, and now you
want to bug them when they are trying to
get a release from what they already
have to deal with? REALLY?!? I've
even read what a few people say if
unsuccessful with getting through to the
officer or presiding Judge - try and plead
with the prosecuting attorney!
REALLY?!? Let's
end with this by saying you will be
remembered and most likely embarrassed
in more ways than not. Don't do
it! Just save yourself a bundle of

8. Get it over with.

I wouldn't recommend trying
any delay tactics. It can work in your
favour if the officer doesn't show up, but it can work
majorly against you.
If you miss the second plus court date, not only
would you be charged the fine and some court
fees, you may be forcibly escorted by an
arresting local public servant (if you
understand what I mean) to the courtroom,
among other places and still need to face the
Judge. Now you have multiple fines.
The more things you request before your court
date (if you decide to go to court) the more you
will be remembered, and the more they will want
to teach you a lesson.

9. You
got to know when to hold dem
|
As I stated in my opening
statements, there are many different processes
of how a court session will proceed. These
proceedings depend heavily on the laws of your
province/state/municipality. However, I
suggest you follow this principle (as I stated

you're going to challenge your ticket don't tip
your hand, in any way, of how you are going to
approach your argument. If you have a plan
don't show it until the Judge asks YOU
to present your case. If the officer or
Prosecution gets wind of how you're going to
defend yourself and they feel it could prevent
them from winning, then you're in trouble
because they know how to operate around things
in their "House"! Another word of advice -
Once you present your argument and it's a good
one, don't allow the Prosecutor to delay
anything. Force the issue until you win. -

Let's say you've
decided to challenge the ticket, you
need to be as calm as you can and
methodical in how you're going to
present your argument. Look,
inside a courtroom can make any novice
nervous-as-heck. It's not a happy
place (unless you win) and every officer
of the law in there knows it. It's
designed to be intimidating and for
outsiders to lose. Before the
trial starts the Prosecution and officer
may offer you a deal. If it's not
in your best interest and you're
strategically prepared, then fight it.
If you don't have a good plan of action
then either take the deal and deal with
the consequences thereafter, try your
best to argue your case to a room full
of law professionals, spend the $200+

(but that doesn't guarantee an outright
win), use the strategies I give you in

hope for a miracle. I believe in
miracles, but there are a couple of
issues that limit their effectiveness?
One, sometimes people fail to realize
when the answers appear right in front

Let's say you've been ticketed and must resort to
fighting for a dismissal of your traffic
violation in court, don't focus your argument on
excuses or reasons, because these Judges have
basically heard them all before. You need
to dispute your case on the foundational
loopholes that already exist and are
established. In plain English, beating a
speeding ticket is possible if you know where
